Terms of Use

1. The Service

The Service receives photos from cameras that people build and place themselves, turns each day of photos into a short time-lapse video, and shows these videos on the website. Accounts, cameras and Locations are free of charge.

The Service is run on a best-effort basis. We may change, add or remove features, set or change limits (for example how many Locations or cameras an account may hold), or pause or end the Service. Where a change significantly affects you, we will tell you in advance where practicable.

2. Your account

• You must be at least 14 years old to create an account.
• An account is personal: one person, one account. Give true information — a real email address you control and a name that does not impersonate anyone.
• Keep your password and your cameras' keys secret. You are responsible for what happens under your account and on your cameras. Tell us at once if you suspect misuse.
• Do not create accounts in bulk or with automated tools, and do not create additional accounts to get around limits or a ban.

3. Your content and who owns it

"Your content" means the photos your cameras upload, the time-lapse videos made from them, and the names, descriptions and other information you enter (for example a Location's name).

You keep ownership of your content. You confirm that you have the right to upload it and that capturing it was lawful where the camera is installed.

4. The licence you give us — public-interest use

DAM exists to build a shared, lasting record of places over time. So that we can run the Service and share that record for the public good, you give us a worldwide, non-exclusive, royalty-free licence to store, reproduce, process (for example resize, crop, correct colour, combine into time-lapse videos), publish, display and distribute your content, and to let others do so, for these purposes:

• operating, showing and improving the Service (including showing your Location's videos publicly on the website);
• public-interest purposes (공공의 이익): scientific and academic research, environmental, climate and weather records, education, cultural and historical archives, public exhibitions, and information about disasters and public safety — by us or by public bodies, schools, researchers and non-profit organisations we share it with.

We will not sell your content as stock images, give it to advertisers, or use it to identify or profile individuals. Where practicable, we credit the source as the Location name and "DAM — chase-nova.com".

The licence starts when content is uploaded. If you delete content or your account, we stop new uses of the deleted content within a reasonable time, but the licence continues for uses already made — for example a video already included in a published study, report, archive or exhibition, and backups kept for a limited time.

5. Where you point your camera

DAM is for landscapes, skylines, weather, nature and public scenery — not for watching people.

• Do not point a camera into homes, windows, gardens, courtyards or other private spaces of others, or at places where people expect privacy (bathrooms, changing rooms and similar).
• Frame the view so that people, faces, and vehicle number plates are not the subject and are not recognisable wherever you can avoid it.
• Follow the laws on cameras and personal information where the camera is installed, including any signage duties and the property owner's permission.
• If we receive a complaint about a view, we may ask you to change it and may hide the Location or its images meanwhile.

6. Prohibited content — zero tolerance

You must not upload, or let your camera capture and upload, any of the following:

• illegal content of any kind;
• sexual content, nudity, pornography or sexually suggestive content — including anything captured by accident that you knowingly leave online;
• any content that sexualises minors. We report it to the authorities;
• hidden-camera, voyeuristic or intimate images, or images of people taken or used without their consent in a way that violates their rights;
• violence, gore, or content that promotes terrorism, hatred or self-harm;
• content that infringes someone else's copyright, trademark, privacy or other rights;
• anything that is not a genuine capture from your camera — for example uploading other pictures, advertising, text or data through the camera connection.

Breaking this section leads to immediate removal of the content and a permanent ban of the account and its cameras, without prior notice. Where the law requires it or people are at risk, we pass information to law enforcement.

7. Abuse of the Service

Do not:

• overload, attack, probe or scan the Service, or bypass its limits, rate limits or security;
• impersonate a camera, send fake or manipulated camera data, or use another person's credentials or tokens;
• use scripts or bots to sign up, request codes or send requests in bulk;
• sell, rent or share access to your account or cameras;
• use the Service to spam, harass, threaten or defraud anyone;
• copy the Service's content in bulk (scraping) beyond normal viewing, except as the law allows.

Abuse leads to suspension or a ban of the accounts and cameras involved. The camera software (rpi-camera-agent) is open source under the Apache-2.0 licence; you may study and change it, but these Terms still apply to anything it sends to the Service.

8. Cameras

You build, install, power and maintain your cameras at your own risk and responsibility, including safe electrical installation and secure mounting. You are the custodian of the cameras you register: keep their keys secret and tell us if a camera is lost or stolen so we can revoke it. We may revoke or disable a camera that breaks these Terms or endangers the Service.

9. What we may do when these Terms are broken

Depending on how serious and how repeated a violation is, we may remove or hide content, disable cameras, limit features, suspend the account, or permanently ban the person — including their other accounts. For serious violations (sections 6 and 7) we act without prior notice. Otherwise we will usually warn you first and tell you the reason.

If you think we made a mistake, write to contact@chase-nova.com within 30 days; we will review the decision and reply.

10. Reporting problems

To report content that breaks these Terms, a camera that films you or your property, or a security issue, write to contact@chase-nova.com with the Location's name or link. We review reports promptly and treat reports of illegal or sexual content with priority.

11. Ending your account

You may stop using the Service at any time and ask us to delete your account by writing to contact@chase-nova.com from your account email. Deleting the account removes your personal information as described in the Privacy notice; section 4 explains what happens to your content. We may end accounts under section 9, or when we end the Service, in which case we will tell you in advance where practicable.

12. No warranty

The Service is free and provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or that every photo or video will be kept. Keep your own copies of anything important. The Service is not a security, surveillance or emergency system — do not rely on it for safety.

13. Liability

To the extent the law allows, we are not liable for indirect or consequential damage, lost data, or damage caused by your camera installation, by other users, or by events outside our reasonable control. Nothing in these Terms limits liability that cannot be limited by law, including liability for our intent or gross negligence, or your rights as a consumer.

You are responsible for your content, your cameras and how you use the Service; if a claim is made against us because you broke these Terms or the law, you will cover the resulting losses to the extent the law allows.

14. Changes to these Terms

We may update these Terms. We will announce changes on the website at least 7 days before they take effect, and at least 30 days before for changes that are to your disadvantage. When the change requires it, we will ask you to accept the new version; until you do, you cannot create Locations or register cameras. If you do not accept, you may stop using the Service and delete your account.

15. Law and disputes

These Terms are governed by the laws of the Republic of Korea. We will first try to settle any dispute with you in good faith. Otherwise, the Seoul Central District Court has jurisdiction, without prejudice to any court that has mandatory jurisdiction under consumer law.

These Terms exist in Korean and English with the same meaning; if the two versions differ, the Korean version prevails.
